DETAILED STEP BY STEP GUIDE TO BUYING
Here at ATC Homes we know that buying abroad can be a big
step as you do not know how the real estate system works and
the legalities of buying. Therefore we have put together
this easy to follow step by step guide to give you an idea
of how to buy your dream property with ease. Throughout this
whole process a representative of ATC Homes will be with you
to guide you along the way and answer any questions you may
have.
STEP 1
You can take an inspection trip to come over and have a look
around property or perhaps you have had a look on a recent
holiday. Firstly ATC Homes will show you around to find the
dream property you are looking for. Once you have found it
we will endeavour to negotiate the best price with the
seller for you.
STEP 2
We would then go to our recommended solicitor where a
contract would be drawn up between the buyer and seller. It
is at this point the solicitor ascertains whether the
sellers owns the property and it can be sold. The solicitor
also makes sure that there is no outstanding charges on the
property and all building permission has been granted. He
also checks to make sure that both parties are happy with
the terms of sale. Once this is done the contract is drawn
up. For an example contract please go to the homepage on our
website and click on Residence sale pre-commitment. The
contract is firstly drawn up in Turkish and then into
English. Throughout the whole process there will be a legal
translator present so you can clearly understand what is
going on and raise any questions you may have. Once the
contracts are done the solicitor, legal translator, buyers
and seller all sign the contracts. The buyer and seller both
receive a copy of the contract and we will keep a copy in
our ATC Homes office for our records.
STEP 3
The deposit needs to be paid to the seller. Time scales as
to when you make payments will be agreed at the solicitors
and detailed in your contract. At this point we also take
our 3% commission.
STEP 4
We then apply for the title deeds and at this point your
details will be sent to the Aegean Military Commandership
for them to carry out Military checks this is a standard
procedure in Turkey. This can take between 6 - 14 weeks.
After the checks have been carried out at the military
office and permission has been granted the paper work is
sent to the deeds office ready to be transferred into the
buyers names.
STEP 5
If you are in Turkey:
We take you to the deeds office where they will require a
passport picture of the buyer to go on the title deeds. In
exchange they will give you tax form which needs to be taken
to the bank and the tax needs to be paid on the property.
Again this is a formality in Turkey and all property
purchased in Turkey must have taxed paid on it before the
title deeds are released. At the bank you will receive a
receipt which will show you that the tax has been paid. The
cost varies as it is dependent on the property value, age
and location but is usually approximately 3% of the sales
price. Whilst at the bank you will also pay any monies
outstanding to the seller at this point. Then the title
deeds will be transferred into the buyers name on production
of the banks tax receipt at the deeds office along with a
legal translator, buyer and seller present for all the
paperwork to be signed over. Throughout this whole process
we will be with you incase you have any queries.
If you are not in Turkey:
You would need to appoint a Power of Attorney in Turkey
before you leave, which we can arrange for you. In this case
before you leave Turkey you will go to the notary office
along with your Power of Attorney to obtain a document
detailing that you will not be present in Turkey at the time
the deeds are released and for the deeds to be signed by
your Power of Attorney on your behalf. Then your Power of
Attorney would deal with step 5 on your behalf. The deeds
will be released in the buyers name.
